Patent Cooperation Treaty (PCT) Information

For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1153 O.G. 3, on Aug. 3, 1993.

For use of the European Patent Office as an International Searching Authority for international applications filed in the United States Receiving Office, see the notice appearing in the Official Gazette at 1022 O.G. 52, on Sept. 28, 1982.

For use of the European Patent Office as an International Preliminary Examining Authority for international applications filed in the United States Receiving Office, see the notices appearing in the Official Gazette at 1080 O.G. 2, on July 7, 1987 and at 1091 O.G. 2, on June 7, 1988. There is no longer a limit on the number of such international applications accepted for international preliminary examination by the European Patent Office; see the notice appearing at 1116 O.G. 32, on July 17, 1990.

The search fee of the European Patent Office was changed, effective Oct. 1, 1993, due to changes in the exchange rate of the U.S. dollar to the German mark, and was announced in the Official Gazette at 1154 O.G. 25, on Sept. 14, 1993.

International fees were changed, effective on May 1, 1993, due to changes in the exchange rate of the U.S. dollar with regard to the Swiss franc, and were announced in the Official Gazette at 1148 O.G. 20, on Mar. 9, 1993.

Certain domestic PCT fees and charges for International Search and Preliminary Examination were changed, effective Oct. 1, 1992, and were announced in the Official Gazette at 1141 O.G. 68, on Aug. 25, 1992.

Notice of Maintenance Fees Payable

Title 37, Code of Federal Regulations, Section 1.362(d) pro- vides that maintenance fees may be paid without surcharge for a six-month period beginning 3, 7, and 11 years after the date of issue of patents based on application filed on or after Dec. 12, 1980. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the mainte- nance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is not paid in a patent requiring such payment the patent will expire on the 4th, 8th or 12th anniversary of the patent.

Attention is drawn to the patents which were issued on De- cember 18, 1990 for which maintenance fees due at 3 years and six months may now be paid. The patents have patent numbers within the following ranges:

35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required maintenance fee and any applicable surcharge are not paid in a
